Terms of Service

These terms are the agreement between you and InstaRep, LLC (“InstaRep”, “we”). By using InstaRep or subscribing, you accept them. If you don’t, please don’t use the service.

1. What InstaRep does

You answer a few questions, our software designs and writes a website for your business, and you can see it free. If you subscribe, we make it live on a real domain, host it, and keep it running. Depending on your plan we may also handle local SEO, show your Google reviews, take bookings on your calendar, and deliver enquiries to you.

2. Your account and your access link

You must be 18 or over and give accurate information. Some features are reached through a private link we send you rather than a password — treat those links like a password, because anyone holding one can change your settings. Tell us promptly if a link is exposed.

3. Plans, billing, and cancelling

  • Plans are $19, $49, or $199 per month as shown on the pricing page. Prices exclude any applicable taxes.
  • Subscriptions renew automatically each month until cancelled, and payment is taken through Stripe.
  • You can cancel at any time. Your site stays up until the end of the period you have paid for, and we do not charge you again.
  • Fees already paid are non-refundable except where the law requires otherwise.
  • If a payment fails we may retry it and, after telling you, suspend or take down the site.
  • We may change pricing, but not in the middle of a period you have already paid for; we’ll give you at least 30 days’ notice, and you can cancel.

4. Domains

Domains we register for you are registered in your name — you own the domain, not us.

Domain registration is subject to the registry’s own rules, and a name you want may already be taken. We renew your domain while your subscription is active; if you cancel, the renewal is your responsibility, and a domain that isn’t renewed will expire. You can transfer your domain away at any time.

5. Who owns what

  • Yours: your business information, your logo and photos, and the text and images on your finished site. You keep ownership of all of it, and you can take your content with you.
  • Ours: the InstaRep platform — the software, the design system, and the templates that produce your site. Subscribing gives you the right to use it, not to own or resell it.

You give us permission to host, display, and modify your content only as far as we need to run the service for you. You confirm you have the rights to whatever you upload.

6. AI-generated content

Your site is written by AI from your answers. AI gets things wrong. Review your site before it goes live and keep it accurate — you are responsible for what it claims about your business, including licences, certifications, guarantees, and prices.

Similar businesses may receive similar wording or layouts, and we don’t promise your copy is unique. Anything we generate for you is yours to use.

7. Enquiries and your customers’ data

When someone contacts you through your site, that information is yours and you are responsible for it: you decide how it’s used, and you must follow the law when you contact people — including the rules on calls and texts, such as the TCPA. We deliver and store enquiries on your behalf, and we don’t sell them or use them to market to anyone.

8. Fair use

Plans that describe unlimited AI edits are for normal use by one business. We may apply reasonable rate limits to keep the service fast for everyone, and we’ll talk to you before restricting anything.

9. Acceptable use

You agree not to use InstaRep to:

  • Break the law, or advertise services you are not licensed to provide.
  • Publish content that is false, misleading, infringing, or that you have no right to use.
  • Impersonate another business or person.
  • Attack, overload, probe, or reverse-engineer the service, or use it to send spam or malware.

We can suspend or remove sites that break these rules, and we’ll tell you why.

10. SEO and results

We cannot promise rankings, traffic, leads, or revenue. Search engines are outside our control, and nobody can guarantee a position in Google’s results. Our SEO plans buy the work — technical setup, content, and reporting — not a specific outcome.

11. Third-party services

InstaRep relies on other companies — Stripe for payments, Google for Calendar and reviews, domain registries, and our hosting providers. Their terms apply to their parts, and an outage or change on their side can affect your site. We’re not responsible for what those third parties do.

12. Availability

We work hard to keep your site up, but we don’t promise uninterrupted service, and we may need downtime for maintenance. Except where the law says otherwise, the service is provided “as is”, without warranties of any kind.

13. Limitation of liability

To the fullest extent the law allows, InstaRep is not liable for lost profits, lost business, lost data, or any indirect or consequential damages. Our total liability for any claim is limited to the amount you paid us in the 12 months before the claim arose. Some places don’t allow these limits, in which case they apply only as far as permitted.

14. Indemnity

You agree to cover InstaRep against claims arising from your content, your use of the service, or your breach of these terms — for example, a claim that something on your site is false or infringes someone’s rights.

15. Ending the agreement

You can cancel at any time. We may suspend or end your account if you break these terms, don’t pay, or use the service in a way that harms others. When the agreement ends, your site comes down and your domain remains yours. Ask us before you go and we’ll help you export your content.

16. Changes

We may update these terms; the date above will change, and material changes will be notified by email. If you keep using InstaRep after a change takes effect, you accept the new terms.

17. Governing law

These terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules, and the state and federal courts located in Florida have exclusive jurisdiction over any dispute.

18. Text messages (SMS)

By entering your phone number on the intake form, you consent to receive follow-up texts from InstaRep about the site we generated for you. Message frequency may vary. Reply STOP to opt out at any time, or HELP for help. Message and data rates may apply, and carriers are not liable for delayed or undelivered messages.
